Washington Supreme Court Rules Groundwater Exemption for Stock-Watering Purposes is Unlimited in Quantity

December 22, 2011

This morning, the Washington Supreme Court issued its opinion in Five Corners Family Farmers v. Washington, et al., a case dealing with whether the groundwater exemption for stockwater could appropriately be used at a 30,000-head feedlot in Franklin County. The Washington Supreme Court ruled that, “under the plain language of the statute, withdrawals of groundwater for stock-watering purposes are not limited to any particular quantity by RCW 90.44.050.”

The issues in this case were addressed in detail in an earlier post.
